That Reading Borough Council intends to demolish the properties listed in the Schedule below (the Properties). The reasons for the intended demolition are that the Properties are located within the proposed development scheme for the regeneration of the Dee Park estate. The proposed demolition date is 30 September 2014.

The date when any final demolition notice or notices relating to the Properties will cease to be in force, unless extended or revoked under the Housing Act 1985 Schedule 5 paragraph 15, is 30 September 2014.

The right to buy will not arise in respect of the Properties.

There may be a right to compensation under section 138C of the Housing Act 1985 in respect of certain expenditure incurred in respect of any existing claim to exercise the right to buy.

NOTICE IS HEREBY GIVEN that Reading Borough Council intends to demolish the properties listed in the Schedule below (the Properties). The reason for the intended demolition is that the Properties are located within the proposed development scheme for the regeneration of the Dee Park estate. The period within which it is intended to carry out the proposed demolition is by 30 June 2011.

The date when any initial demolition notice or notices relating to the Properties will cease to be in force, unless revoked or otherwise terminated under the Housing Act 1985 Schedule 5A paragraph 3, is the 10 July 2011.

During the period of validity of any such notice or notices the landlord will not be under any obligation to make a grant of the freehold or of a lease of any dwelling comprised in the Properties in respect of any claim to exercise the right to buy in respect of any such dwelling.

There may be a right to compensation under section 138C of the Housing Act 1985 in respect of certain expenditure incurred in respect of any existing claim to exercise the right to buy.

What this means to tenants

Amendments made on 18th January 2005 to the Housing Act 2004 allow landlords to serve Demolition Notices where areas are identified for regeneration and redevelopment.

In preparation for the regeneration of Dee Park, the Council is now serving an "Initial Demolition Notice" on tenants living in the flats in Lyon Square which are likely to be demolished during the re-development programme. This means that tenants living in these properties will have their right-to-buy suspended for up to five years. Before the Initial Notice comes to an end the Council can serve a "Final Notice of Demolition" which means the right-to-buy will be suspended for a further two years.

Tenants can still apply to buy their homes during the Initial Notice period, but the Council can withhold the completion of the purchase whilst the regeneration scheme is being progressed. If for some reason the regeneration plans do not go ahead and the Council does not demolish the property the sale could be completed as soon as the Notice ends.

The serving of this notice does NOT mean that Lyon Square will be demolished in the near future. We expect to appoint a development partner to undertake the regeneration work by early 2007. Building work is then not likely to start before early 2008.

When the time comes to demolish the flats a detailed re-housing interview will be held with tenants. The intention is for all family households and those in sheltered housing to have an opportunity to move into a new home on the estate if they choose. A considerable number of single person households will also be able to move into a new flat on the estate if they wish. However, we are aware that not everyone will want to stay on the estate, therefore a range of other options will also be available - including new and existing Housing Association and Council flats in other areas of Reading Borough. We will work with individual households to try to find the best re-housing option for them. Tenants will be offered support to help them move plus compensation to cover their costs and the inconvenience of moving.

If a tenant moves from Lyon Square flats into another Council property elsewhere in the Borough and they meet the qualifying criteria* they will then automatically retain their right-to-buy. There are similar rights for tenants who move into Housing Association homes.

If you live in Lyon Square and your home is likely to be demolished you will have received a formal "Initial Demolition Notice" by post.
