Employing a PA

If you decide to have a Personal Assistant (PA) you will become an employer, with employer’s responsibilities and legal duties.

You don’t have to manage these alone – there are a number of support services that can offer the support you need to help you recruit and retain staff, meet your responsibilities and enjoy the benefits of having your own PA. We can cost this into the support plan.

This information is provided for Adult and Children Social Care clients receiving Direct Payments, but may also be helpful for people who fund their own care.

Available support

An employment advice and support service will be able to help you with recruitment, make sure you are clear about your legal responsibilities and advise you on best practice to help you manage and retain your PA. We will cost this into the support plan. Employment advice and support can include things like:

Recruitment

  • Job descriptions/person specifications
  • Advertising and interviewing
  • References and “Right to Work” checks
  • Contracts of employment

Training and development

  • Induction
  • Health and safety
  • Ongoing development

Legal responsibilities

  • Health and safety
  • Employer’s Liability Insurance

Employee rights

  • Payroll and pensions
  • Redundancy
  • Maternity/paternity/adoption
  • Parental leave

Day-to-day management

Using advice and support services

It is completely up to you whether you choose to use an advice and support service. Whilst some people find they are able to undertake the employment process with self-serve advice, others find they need more support to undergo this process. If you choose to manage this on your own, you can find information and advice online:

Whilst Reading Borough Council has undertaken reasonable checks to ensure the credentials of all providers on this list, no liability will be taken by the Council for any losses incurred by the Direct Payment holder.

We have compiled a preferred providers list for this service. Whilst you don’t have to use one of our preferred providers, they have all been subject to financial due diligence checks and are experienced in providing support of this type.
