MCA and DOLS for practitioners

Target Group

Qualified care management practitioners in adult social care teams (social workers and OTs) including BHFT community mental health staff.  This is mandatory training for staff in these roles as agreed by Heads of Service. Managers are asked to prioritise applications from qualified staff but unqualified staff can apply if spaces are available.

Course Aims

To explore the responsibilities of all practitioners in health and social are under the Mental Capacity Act2005 with a specific focus on the duty to identify situations where a person is deprived of their liberty and what practical steps need to be taken to ensure necessary restrictive or protective care arrangements are lawful.

Course Outcomes

  • Understand the core principles of the Mental Capacity Act and its application in everyday practice;
  • Be confident to recognise when care arrangements amount to a deprivation of liberty including individuals supported in the community
  • Understand when they must use the Deprivation of Liberty Safeguarding procedure and what this will involve.
  • Understand when an application to the Court of Protection is necessary and what that will require
  • Be aware of the proposals for change in this area of practice which are currently the subject of national consultation.
