Emissions based parking charges order 2026
The Reading Borough Council (hereinafter referred to as “The Council”), pursuant to its powers under Sections 1(1), 2, 2(1), 3, 4(2), 32, 35, 49, 53, 122(1) and 122(2) and Part IV of Schedule 9 to The Road Traffic Regulation Act 1984 (The Act of 1984) and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part Ill of Schedule 9 to the Act of 1984, hereby make the following Order:
1. Citation and commencement
This Order may be cited as “The Borough of Reading (Emissions Based Parking Charges) (Amendment) Order 2026 and shall come into operation on 2 February 2026.
2. Interpretation
2.1 The Interpretation Act 1978 (as amended) shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.
2.2 Any reference in this order to any enactment shall be construed as a reference to that enactment as 9mended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.
2.3 The prohibitions imposed by this Order shall be in addition to and not in derogation of any restrictions or requirements imposed by any regulations made, or having effect as if made, under the 1984 Act or by or under any other enactment.
2.4 The purpose of this Order is to introduce Emission based parking charging on street and depends on the amount of carbon dioxide, nitrogen dioxide, or particulate matter that a vehicle emits. The more harmful substances a vehicle emits, the higher the charge would be to park their vehicle.
3. Definitions
Carbon Dioxide Emissions Figure has the same meaning as in the Vehicle Excise and Registration Act 1994, as amended. For the avoidance of doubt, this is intended to have the same meaning as that used by DVLA for the purpose of vehicle excise duty at the time when this order was made. If there should be any future amendment to the meaning as used by DVLA, such amendment will not, of itself, be binding on the Council for the purposes of this order.
Digital Parking Permit means an electronic record of a parking permit/ticket that has been registered to a vehicle through the Council’s online Digital parking permit system.
Diesel vehicle means a vehicle in which the motive power is derived from a compression ignition engine.
Disabled Persons Badge means a badge which was:
(a) issued, or has effect as if issued, to a Disabled Person or an institution under the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000 (as amended) or under Regulations having effect in Scotland or Wales under Section 21 of the Chronically Sick and Disabled Persons Act 1970; and
(b) has not ceased to be in force.
DVLA means the Driver and Vehicle Licensing Agency.
Electronic Payment System means a computerised system operated by or on the behalf of the Council or its Authorised Agent whereby the driver of a vehicle, or some other person authorised by that driver on their behalf, uses an electronic device to make payment of a Parking Charge in respect of a specified vehicle, a specified Parking Place and for a specified parking period and which records details pertaining to such payment, vehicle, Payment Parking Place and period of parking.
Inner Central Tariff Zone means the streets listed below to which the Inner Central Tariff applies:
Abbey Street, Blagrave Street, Castle Street, Cheapside, Cintra Avenue, Crossland Road, Deansgate Road, East Street, Eldon Square, Fobney Street, Friar Street, Garrard Street, Great Knollys Street, Hosier Street, Howard Street, Kenavon Drive, Kings Road, London Street, Mill Lane, Northfield Road, Oxford Road, Sackville Street, Sidmouth Street, South Street, St Mary’s Butts, Stanshawe Road, The Forbury, Thorn Street, Vachel Road, Valpy Street, We/dale Street, West Street
Outer Central Tariff Zone means the streets listed below to which the Outer Central Tariff applies:
Addington Road, Al/croft Road, Alexandra Road, Denmark Road, Elmhurst Road, Erleigh Road, Kendrick Road, Morgan Road, Oxford Road, Redlands Road, Upper Redlands Road
Out of Town Tariff Zone means the streets and parking areas listed below to which the Out of Town Tariff applies:
Wokingham Road and Pepper Lane
Parking Charge means a charge payable as specified in Schedule 2 of this Order for leaving a vehicle in a Payment Parking Place as specified in any of the Principal Orders specified at Schedule 1 of this Order.
Parking Place means a road or any length of road designated as a parking place in any of the Principal Orders specified in Schedule 1 of this Order.
Payment Parking Ticket means a ticket dispensed by a parking ticket machine after payment of the parking charge which shows the date and time of expiry of the parking period purchased.
Payment Parking Place means a road or any length of road designated as a parking place for which payment in required in any of the Principal Orders specified in Schedule to this Order, which is provided by the Council for the leaving of a vehicle under the provisions of that relevant Order, and is indicated by the prescribed traffic signs.
Penalty Charge(s) means a charge payable in respect of a road traffic contravention under the Traffic Management Act 2004 and regulations made under it.
Permitted Hours means the hours during which a vehicle may wait in a Payment Parking Place, whilst complying with the relevant provisions of this Order and shown
by or on a traffic sign in the vicinity of that Payment Parking Place, specified in any relevant Order in Schedule 1 to this Order.
Petrol Vehicle means a vehicle in which the motive power is derived from a spark ignition engine.
Principal Orders means the orders listed in Schedule 1 to this Order.
Relevant Position means:
In the case of a Disabled Person’s Badge:
A Vehicle displays a Disabled Person’s Badge in the Relevant Position if:
- the badge is clearly exhibited on the dashboard or facia of the Vehicle, so that the quarter-hour period during which the period of waiting began is legible from outside the Vehicle; or
- where the Vehicle is not fitted with a dashboard or facia, the badge is clearly exhibited in a conspicuous position on the vehicle, the badge is exhibited in a conspicuous position on the vehicle so that the quarter-hour period during which the period of WaitiC1g began is legible from outside the Vehicle.
In relation to a Digital Parking Permit means visible to a Civil Enforcement Officer checking the Vehicle using handheld device with an indication of the date and time of expiry of the parking period for which such Parking Charge has been paid for the purpose of checking for a valid Digital Parking Permit.
In the case of any other badge or permit:
A Vehicle displays a Payment Parking Ticket, a permit or any other badge in the Relevant Position if:-
- in the case of a Vehicle fitted with a front windscreen, the item is exhibited thereon with the obverse side facing forwards on the near side of and immediately behind the windscreen so that all details, including the expiry time, are clearly visible and easily readable from outside the vehicle; or
- in the case of a Vehicle not fitted with a front windscreen, the item is exhibited in a conspicuous position besides, on the front or near side of the Vehicle so that all details, including the expiry time, are clearly visible and easily readable from outside the vehicle.
Standard Tariff Rate means the parking charge as set out in the Scale of Charges, corresponding to the column marked for the lowest pricing band (i.e. 0-150 g/km) and determined by the length of stay in the relevant Tariff Zone.
Tariff Zone means either the Inner Central Tariff Zone, Outer Central Tariff Zone or the Out of Town Tariff Zone.
Telephone Parking Payment System means a system to facilitate and monitor the payment of Parking Charges using any telephone device via communication with the said provider, in accordance with instructions indicated on signs located by each Parking Place.
Vehicle Emissions (g/km) means the amount, in grams, of carbon dioxide emissions a vehicle generates per kilometre driven.
4. Parking charges amendments
4.1 Where any of the Principal Orders listed in Schedule 1 to this Order specify a scale of charges in the schedules referenced therein, those charges shall be deleted and substituted with the applicable scale of charges set out in Schedule 2 to this Order, determined by the location of the road (Inner Central, Outer Central, or Out of Town Tariff Zone) and the fuel type of the vehicle (Petrol or Diesel).
4.2 There shall be inserted a new Schedule 12 in the Borough of Reading (Civil Enforcement Area) (Waiting Restrictions Review 2021b) Order 2022 as set out in Schedule 3 to this Order.
4.3 There shall be inserted a new Schedule 11 in the Borough of Reading (Civil Enforcement Area) (Waiting Restrictions Review 2022a) Order 2022 as set out in Schedule 4 to this Order.
4.4 There shall be inserted a new Schedule 13 in the Borough of Reading (Civil Enforcement Area) (Waiting Restrictions Review 201?B) Order 2018 as set out in Schedule 5 to this Order.
5. Parking places and payment of parking charges
5.1 No person shall cause or permit any vehicle, other than one displaying a valid Payment Parking Ticket obtained from a ticket machine or having a record of a parking payment transaction on the Telephone Parking Payment System or an Electronic Payment System, to wait in a Payment Parking Place during the Permitted Hours in any of the relevant order(s) specified in Schedule 1 to this Order.
5.2 A Payment Parking Ticket shall be issued by a ticket machine, within the vicinity of that Parking Place, or a record of a payment parking period shall be recorded on the Telephone Parking Payment System or an Electronic Payment System, upon payment of the Parking Charge specified in Schedule 2 of this Order. The Parking Charge shall be paid using the appropriate banknotes, coins, electronic payment card, or by phone and may include any administrative fee for use of the Telephone Parking Payment System. The charges payable are determined in accordance with the Carbon Dioxide Emissions Figure of the vehicle, as recorded in the vehicle’s registration document or certificate. Where no such figure is recorded, the over 255 CO2 band shall apply.
5.3 Upon payment of the Parking Charge applicable to the vehicle based on its Carbon Dioxide Emissions Figure or where there is no charge for an initial period of time as indicated in Schedule 2 and on the ticket machine in the vicinity of the Payment Parking Place, the driver shall continuously display in the Relevant Position on the vehicle a valid Payment Parking Ticket issued by a ticket machine relating to the Payment Parking Place in which the vehicle is left. This ticket must be valid for that day and time and must be displayed throughout the stay of the vehicle unless there has been recorded on the Telephone Parking Payment System or an Electronic Payment System a valid record of the parking period for that vehicle.
5.4 Where a vehicle is classified as a hybrid (powered by both electricity and an internal combustion engine), the applicable Parking Charge shall be determined by reference to the CO2 emissions figure stated on the vehicle’s registration certificate (V5C). If no such figure is recorded, the charge shall be calculated based on the engine capacity of the internal combustion component.
5.5 Where a vehicle is classified as fully electric (powered solely by electricity), the applicable parking charge shall be the Standard Tariff Rate.
5.6 It shall be the responsibility of the Driver to ascertain and keep up to date the engine type and emissions classification of their vehicle.
5.7 Any reference to displaying a Payment Parking Ticket in Articles 5.3 does not apply where payment is made via a Telephone Parking Payment System or an Electronic Payment System and this can be validated through a handheld device with an indication of the date and time of expiry of the parking period for which such Parking Charge has been paid.
5.8 Save as provided in Article 5.10 no person shall cause or permit any vehicle to remain in a Payment Parking Place during the Permitted Hours for longer than the maximum stay period specified in any of the Principal Orders listed in Schedule 1 to this Order.
5.9 A vehicle which has been taken away from a Payment Parking Place after the initial period of parking has expired shall return within a period separated by an interval of not less than the time period specified in any of the Principal Orders listed in Schedule 1 to this Order for that Payment Parking Place as a period of no return.
5.10 The Payment Parking Place may be used without any limit on time, subject to the provision of this Order, for the leaving during the Permitted hours of a vehicle which displays in the Relevant Position a Disabled Persons Badge, but only if that vehicle has been or is about to be driven or used by the person to whom the badge has been issued, or as the case may be, used for carrying of disabled person(s) as passenger(s).
5.1 If at any time when a vehicle is left during the Permitted Hours in a Payment Parking Place there is on the nearest ticket machine a notice placed by any person duly authorised by the Council indicating that the ticket machine is out of order, then a ticket shall be obtained where possible from the nearest other available ticket machine or by using a Telephone Parking Payment System.
6. Contravention
If a vehicle is parked without complying to the provisions of this Order, it will be considered a contravention and a Penalty Charge will become payable. Should the vehicle remain in contravention following the issuance of a Penalty Charge, further Penalty Charges may be issued for each subsequent day the contravention continues, starting from the day after the initial observation.
7. Effect of this order
Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into force of this Order, the orders listed in Schedule 1 to this Order shall continue in full force and effect subject to the incorporation of the provisions detailed in this Order.
